On September 17, 2025, Attorney Dillon Sharpe filed a Notice of Appeal in Anthony Drayton’s case, moving his misdemeanor conviction for Resisting a Public Officer to Pitt County Superior Court for a jury trial.

At the District Court level, the Pitt County DA’s Office pushed ahead on both misdemeanor charges: Assault on a Government Official and Resisting a Public Officer. The State argued that Greenville Police officers’ actions were justified and refused to dismiss the case.

Attorney Sharpe subpoenaed Officer Jennifer Umphlet, the officer caught on video striking Anthony in the head with handcuffs. Despite being properly served and notified, Umphlet never appeared in court. The DA’s Office admitted they had no intention of calling her as a witness because “she does not help their case.”

Anthony’s arraignment in Superior Court is scheduled for November 5, 2025, in Pitt County.
